CONCERNING
TECHNICAL PROVISIONS ON THE ISSUANCE OF CERTIFICATE OF ORIGIN
TO INDONESIA'S EXPORTED GOODS

THE DIRECTOR GENERAL OF FOREIGN TRADE,

Considering:

that following the issuance of Decree of the Minister of Industry and Trade of the Republic of Indonesia No. 618/MPP/Kep/10/2005 concerning the Issuance of Certificate of Origin to Indonesia's Exported Goods, it is necessary to stipulate its technical provisions;

Decision of the Director General of Foreign Trade No. 06/DJPLN//KP/III/2002 concerning Technical Provisions on Certificate of Origin of Indonesia's Exported Goods.

To stipulate:

REGULATION OF THE DIRECTOR GENERAL OF FOREIGN TRADE CONCERNING TECHNICAL PROVISIONS ON THE ISSUANCE OF CERTIFICATE OF ORIGIN TO INDONESIA'S EXPORTED GOODS

Article 1

(1) Every institution issuing Certificate of Origin (SKA) shall convey names of officials authorized and responsible to sign SKA as well as substitute officials, specimens of signatures and specimen of special seal of SKA to the Directorate of Export and Import Facilitation, Ministry of Industry and Trade by using the form as contained in Attachment I to this regulation.

(2) In the case of any change in the officials authorized and responsible to sign SKA and substitute officials, as meant in paragraph (1), the institution issuing SKA shall convey all names of the old and new signing officials, specimens of signatures and specimen of special seal of SKA to the Directorate of Export and Import Facilitation, Ministry of Industry and Trade.

(3) The Directorate of Export and Import Facilitation, Ministry of Industry and Trade shall forward the names, specimens of signatures and specimen of special seal of SKA to Representatives of the Republic of Indonesia abroad to be conveyed further to the authorized government institutions in their accreditation countries.

(4) The officials authorized and responsible to sign SKA and substitute officials officially can sign SKA after receiving letter of appointment from the Director General of Foreign Trade, Ministry of Industry and Trade.

Article 2

The officials who are authorized and responsible to sign SKA and or their substitute officials who have been stipulated before issuance of this Decision, are still authorized and responsible to sign SKA until issuance of appointment of new officials who is authorized and responsible to sign SKA and or their substitute officials.

Article 3

Procurement and distribution of SKA form is conducted as follows:

Article 4

Institutions issuing SKA shall convey report on the receipt and use of SKA form on a monthly basis to the Secretary of the Directorate General of Foreign Trade, the Ministry of Industry and Trade by using form of reports as specified in Attachment II to this regulation.

Article 5

(1) Institutions issuing SKA shall mention the reference number on every kind of SKA form by putting abbreviation to names of the respective regions of institutions issuing SKA.

(2) The abbreviation to names of regions as meant in paragraph (1) shall be as listed in Attachment III to this regulation.

Article 6

Technical directives regarding institutions issuing SKA, Procedures and Mechanism of the Issuance of SKA and Verification of SKA shall be stipulated by the Director General of Foreign Trade, the Ministry of Industry and Trade as specified in Attachment IV to this regulation.

Article 7

(1) Any null or spoiled forms of Certificates of Origin (SKA) shall be destroyed.

(2) In order to realize the destruction of forms of SKA as meant in paragraph (1), a Team for Destruction of Forms of Certificates of Origin (SKA) shall be established by the Institutions Issuing SKA.

(3) In connection with the destruction of forms of SKA, a Minutes of Destruction of Certificates of Origin shall be made and reported to the Directorate General of Foreign Trade, cq. the Secretary of the Directorate General of Foreign Trade, the Ministry of Industry and Trade, by mentioning kinds of forms, serial numbers and number of sets of the destroyed SKA forms.

Article 8

This Decree shall come into force 3 (three) months as from the date of stipulation.
